These Terms of Service ("Terms") govern your access to and use of the Kliniq mobile application and associated website (collectively, the "Service"), operated by Kliniq ("we," "our," or "us"), headquartered in Karachi, Pakistan.
Please read these Terms carefully. By downloading, installing, or using the Kliniq app, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By accessing or using Kliniq, you confirm that you are at least 18 years old (or the legal age of majority in your jurisdiction), have read and understood these Terms, and agree to be legally bound by them.
If you are using Kliniq on behalf of a clinic or organisation, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
Kliniq is an AI-powered clinic management mobile application that provides the following core features:
- Online appointment booking for patients.
- Clinic and schedule management for clinic owners.
- Receptionist tools for managing patient flow and bookings.
- Doctor profiles, availability settings, and appointment views.
- Real-time slot availability and appointment reminders.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Accounts & Registration
3.1 Account Creation
You must create an account to use Kliniq. You agree to provide accurate, complete, and current information at registration and to keep this information updated.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at contact@kliniqapp.com if you suspect unauthorised access.
3.3 One Account Per User
Each individual may only maintain one active personal account. Clinic owners may create one clinic account. Creating multiple accounts to circumvent restrictions is not permitted.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Provide false, misleading, or inaccurate information about yourself or your clinic.
- Use the Service to harass, threaten, or harm any other user.
- Attempt to gain unauthorised access to any part of the Service or another user's account.
- Use automated scripts, bots, or scrapers to access or extract data from the Service.
- Interfere with or disrupt the integrity or performance of the Service.
- Upload or share content that is defamatory, obscene, or violates any applicable law.
- Misrepresent your professional qualifications (for doctors listing on the platform).
5. Healthcare Disclaimer
Kliniq is an appointment management tool only. We do not:
- Provide medical advice, diagnosis, or treatment.
- Verify the medical credentials or licences of doctors registered on the platform.
- Guarantee the quality of care provided by any clinic or healthcare professional.
Any health-related decisions you make based on information obtained through Kliniq are made at your own risk. Always consult a qualified healthcare professional for medical concerns.
Patients are responsible for verifying the credentials and suitability of any doctor or clinic they choose to visit through the platform.
6. Intellectual Property
All content, features, and functionality of the Kliniq Service — including but not limited to the app design, logo, text, graphics, and software — are owned by Kliniq and protected by applicable intellectual property laws in Pakistan and internationally.
You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our written permission.
Content you submit to the Service (such as profile information or appointment notes) remains yours. By submitting it, you grant Kliniq a licence to use it to provide and improve the Service.
7. Subscriptions & Billing
Kliniq offers subscription plans for clinics. All pricing is available upon request through our sales team.
7.1 Payment
Subscription fees are billed as agreed in your plan. All payments must be made in Pakistani Rupees (PKR) unless otherwise specified in your agreement.
7.2 Refunds
As a general policy, subscription fees are non-refundable. If you believe a charge was made in error, contact us at contact@kliniqapp.com within 7 days of the charge.
7.3 Free Trial
Where a free trial is offered, it is limited to one trial per clinic. At the end of the trial, continued use requires a paid subscription.
8. Termination
You may terminate your account at any time by contacting us. Upon termination, your access to the Service will cease.
We reserve the right to suspend or terminate your account without notice if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law.
Upon termination, clauses relating to intellectual property, disclaimers, limitation of liability, and governing law will survive.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Kliniq shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:
- Loss of data or appointment records.
- Service downtime or interruptions.
- Errors in appointment scheduling or notifications.
- Actions of third-party healthcare providers.
Our total liability in connection with the Service shall not exceed the amount you paid to us in the 3 months preceding the claim.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Pakistan. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Karachi, Pakistan.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by sending you an in-app notification or email. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
